ALPHA ESPORTS AND TECHNOLOGY CONSENT, RELEASE, WAIVER, AND INDEMNITY AGREEMENT

TO BE READ AND SIGNED BY EACH PLAYER OR THE PARENT/GUARDIAN OF EACH PLAYER UNDER THE AGE OF 17 BEFORE PARTICIPATING IN AND/OR BEING A PART OF THE EVENT HEREINAFTER DESCRIBED.
In consideration of being permitted to participate at Alpha Esports & Technology or be a part of an Alpha Esports & Technology Event (hereinafter referred to as the “Event”), Releasor, for themselves, their spouse, legal representatives, heirs, and assigns, (herein collectively referred to as “Releasor”) hereby releases, waives, and discharges in advance, Alpha Cyber Security LLC and Alpha Esports & Technology (“Company”), and their respective officers, agents, servants, employees, guests, business invitee, promoter, sponsors, Landlord and advertisers (herein collectively referred to as “Releasees”), from all liability to Releasor, for any and all loss or damage, and any claim or damages resulting from and/or on account of injury to Releasor’s person or property, even injury resulting in the death of the Releasor, whether caused by the negligence of Releasees or otherwise while the Releasor is participating in or being a part of the Event being conducted by Releasees.
This Consent, Release, Waiver, and Indemnity Agreement specifically embraces each occurrence and action authorized or promoted by said Releasees during the entire Event and applies to each circumstance or activity herein above mentioned and has the same effect as if executed after every activity or occurrence in which the Releasor participates so that the parties herein intending to be released and indemnified shall be fully and effectively released and indemnified as to every occurrence and activity hereinabove described.
Additionally, should it be necessary according to the judgment of officials or coaches in the program, any licensed physician or nurse on the scene, or any emergency medical professional, for myself/my child to be treated for injuries, diagnosed or surmised, and/or to be transported to a medical facility for additional treatment,
I hereby give permissions for this to be done, even if I am not on the scene to provide verbal authorization, and if I am on the scene, even if I decline to have said child treated and/or transported.
ADULT SUPERVISION
I understand that children under the age of 16 need to be accompanied by an adult while using the facility. Should that supervision leave the facility at any time they assume all responsibility.
I understand that the minor listed as the PLAYER(S) above is at least nine (9) years old and is not being placed under the care or supervision of Alpha Esports & Technology or its employees. All players during these events are required to abide by all Alpha Esports & Technology rules and guidelines. Failure to do so will result in the player being removed from the event, and the player will not be allowed to participate in any future events. Participation in events may result in the awarding of prizes, including but not exclusive to cash, products, or digital products.
I further understand that some events or tournaments are operated by 3rd party companies or organizations that may award prizes, and the Company is not liable for any aspect of the distribution of those prizes. I also assume all responsibility and liability for any property that is lost, stolen, or damaged and/or for any injury, accidental or intentional, to the above-named minor while at Alpha Esports & Technology and its surrounding areas.
COVID-19 & COMMUNICABLE DISEASE UNDERSTANDING
Participation includes possible exposure to and illness from infectious diseases including, but not limited to, MRSA, influenza, and COVID-19. While particular rules and personal discipline may reduce this risk, the risk of serious illness and death does exist; and I knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of the releases or others, and assume full responsibility for my participation. I agree to comply with all precautionary rules against infection diseases. If, however, I observe any significant hazard, I will remove myself from participation and bring such to the attention of the nearest Alpha Esports and Technology staff member immediately.
GAME CONTENT
Some game ratings do include violence and/or mature content. I am aware of the game content and rating system (E, T, M, A) and give my child permission to participate in the game, fully understanding that there is mature content and releasing Alpha Esports & Technology from any liability or fault for any resulting negative effects my child may or may not experience. (See below to provide consent for a specific game rating classification)
MULTI-AGE ENVIRONMENT
I acknowledge that unless specifically identified for an age bracket, many of the programs run by Alpha Esports & Technology may be multi-age and the content and game ratings will vary based on members using the space at a specific time and date.
PHOTO, VIDEO and SOUND RECORDING RELEASE and CONSENT.
I also understand that the Company may photograph, videotape, or otherwise memorialize my activities with said Company. I hereby grant my consent to the same and to the Company’s use of my likeness, photograph, or videotape in its endeavors which may include advertisement materials and/or commercials.
I have read and agree to abide by the Alpha Esports & Technology rules, which are posted at the front of the store and provided through the website at AlphaEsportsTech.com In signing this Consent, Release, Waiver, and Indemnity Agreement,
WAIVER and RELEASE
I hereby waive, release, and discharge any and all claims, demands, actions,
rights, and causes of action for any and all Injuries/Damages, known or unknown, related to, arising
from, or traceable either directly or indirectly to my participation in the Activities (collectively the
“Released Claims”).
I FULLY RECOGNIZE THAT IF THE GUEST IS INJURED OR THEIR PROPERTY IS DAMAGED WHILE PARTICIPATING IN OR BEING A PART OF THE EVENT CONDUCTED BY RELEASEES, I WILL HAVE NO RIGHT TO MAKE A CLAIM OR FILE A LAWSUIT AGAINST THE RELEASEES EVEN IF THEY OR ANY OF THEM CAUSE MY INJURY OR DAMAGE.
